Terms and Conditions

1. Introduction

These Terms & Conditions govern your use of LiberiComm. By creating an account or using the platform, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must stop using the platform immediately.

2. Eligibility

2.1 Age Requirement

You must be at least 18 years old to create an account with resource-creation privileges or to hold a paid subscription.

2.2 Use by Children

Children may only access LiberiComm through pupil accounts created and supervised by an adult user.

2.3 Responsibility for Pupil Accounts

Adult users are fully responsible for the management, supervision, and use of all pupil accounts they create.

2.4 Legal Ability to Enter Agreements

By using LiberiComm, you confirm that you have the legal capacity to enter into binding agreements under UK law.

3. Subscription Plans

3.1 Available Plans

LiberiComm offers Free, Player, Creator, and School plans, each providing different features and limits.

3.2 Billing and Payments

All payments are securely processed through Stripe. Charges are billed in GBP and may include local taxes.

3.3 Upgrading Your Plan

Upgrades take effect immediately. Additional charges may be prorated based on the remaining billing cycle.

3.4 Downgrading Your Plan

Downgrades take effect at the end of the current billing period. Plan limits (e.g., pupil account limits) apply immediately where relevant.

3.5 Cancellations

You may cancel your subscription at any time in your account settings. Access continues until the end of the current billing cycle.

3.6 Payment Failures

If payment fails, Stripe may retry during a short grace period. If all attempts fail, your plan automatically changes to the Free plan.

3.7 No Refund Policy

All subscription payments are final. LiberiComm does not provide refunds for unused periods, unused features, or accidental purchases.

4. Account Management

4.1 Registration Requirements

You must register with a valid email address. Providing a name is optional for adult users.

4.2 Security of Login Details

You are responsible for keeping your password and login details secure.

4.3 Pupil Accounts

Adult users may create pupil accounts for children under their supervision. A pupil name is required (first name only is sufficient unless unavailable). Pupil accounts have their own login but can only access activities assigned to them by an adult user.

4.4 Account Ownership

Accounts are non-transferable. Sharing or transferring login details to another person is not permitted. A user may only be logged into one device at a time; if a second login attempt is made, the session on the first device will be automatically signed out.

4.5 Account Deletion

You may delete your account at any time. All pupil accounts will be deactivated immediately. User-generated resources will be handled according to the User Content section.

If you have an active subscription, you must cancel it through the Billing Portal before deleting your account. Failure to cancel your subscription may result in continued charges until the end of the billing period.

5. User Content

5.1 Ownership of Content

You retain full ownership of all resources and materials you create on LiberiComm. Access to create, edit, or use resources may be restricted when a user downgrades to a plan that does not include those features. Ownership is retained, but certain functionalities (such as playing or editing resources) require an active Player or Creator subscription.

5.2 Responsibility for Uploaded Content

You are solely responsible for ensuring that any images, text, or materials you upload do not infringe copyright or violate third-party rights. If an uploaded image requires attribution, credit must be included in the resource description

5.3 Public and Private Resources

You may publish resources publicly or keep them private. Public resources may appear in the Resource Library and be visible to other users.

5.4 Deletion of Content by the User

If you delete a resource, it is removed from the public library immediately.

If the resource is currently assigned to a pupil, permanent deletion will occur only after the assignment expires.

5.5 Deletion of a User Account

If you delete your LiberiComm account:

  • All of your resources will be removed from the public library immediately.
  • Resources assigned to pupils will remain available until the assignment expires, after which they will be permanently deleted.
  • Your account data will be deleted in accordance with our Privacy Policy.

5.6 Moderation

LiberiComm uses automated content moderation tools provided by OpenAI to help identify inappropriate or unsafe text and images, including both AI-generated and user-uploaded content. Content may be automatically flagged based on OpenAI’s moderation policies.

LiberiComm may remove any content that:

  • contains profanity or inappropriate language
  • includes harmful, abusive, or discriminatory material
  • displays personal data of children without consent
  • uses copyrighted content without permission
  • poses danger, promotes illegal activity, or violates any laws or platform rules

Although automated moderation is used, LiberiComm does not manually review every resource but may take action when content is flagged or reported.

6. Prohibited Conduct

6.1 Unacceptable Use of the Platform

You must not use LiberiComm in any way that:

  • violates any applicable laws or regulations
  • infringes the rights of others
  • disrupts the platform or harms other users
  • attempts to bypass security measures or access restricted areas

6.2 Prohibited Content

You must not upload, generate, or publish:

  • profanity, offensive, or discriminatory language
  • harmful, abusive, or threatening material
  • personal data of children without consent
  • sexually explicit, violent, or dangerous content
  • copyrighted materials without permission

6.3 Misuse of AI Tools

You must not use AI image generation for:

  • creating unsafe or harmful content
  • generating copyrighted or trademarked work to misuse or impersonate it
  • exploiting the service for mass-generation or scraping

6.4 Restrictions on Pupil Accounts

Pupil accounts must not be used for communication, social interaction, or sharing personal information with others.

7. Pupil Accounts and Access

7.1 Creation of Pupil Accounts

Adult users may create pupil accounts to support the learning of children under their supervision. A pupil name is required (first name only unless unavailable).

7.2 Access Limitations

Pupil accounts can only access activities assigned by an adult user. They cannot create resources, modify settings, or interact with other users.

7.3 Login Permissions

Pupil accounts have their own login credentials but are restricted to a simplified interface designed only for playing assigned activities.

7.4 Behaviour on Plan Changes

  • Creator → Player: Only the first 15 pupil accounts remain active; the rest are deactivated.
  • Paid → Free: All pupil accounts are deactivated immediately and permanently deleted after 30 days unless a paid plan is reactivated.
  • Player → Creator: All previously existing pupil accounts are restored if within the 30-day reactivation window.

7.5 Security

Pupil logins must not be shared or used by adults or other pupils. Adult users are responsible for supervising pupil access.

8. Payments and Billing

8.1 Subscription Charges

Users agree to pay the fees associated with their chosen subscription plan. Prices are listed in GBP and may be updated with reasonable prior notice.

8.2 Billing Cycle

Subscription plans are billed automatically on a monthly or annual basis, depending on the user’s selection at the time of purchase.

8.3 Payment Method

Users must provide a valid payment method. Failed payments may result in restricted access until payment issues are resolved.

8.4 Plan Upgrades and Downgrades

  • Upgrades: Changes take effect immediately, and the price difference is charged on a pro-rated basis.
  • Downgrades: Changes take effect at the end of the current billing cycle.
  • Pupil Account Changes: In line with Section 7.4, pupil accounts may be restricted or deleted if the chosen plan no longer supports them.

8.5 Refunds

All subscription payments are non-refundable except where required by UK consumer law.

8.6 Tax

At present, OmniComm is not VAT-registered, and prices do not include VAT. If VAT registration becomes required in the future, users will be notified before any changes take effect.

8.7 Payment Security

All transactions are processed by a secure third-party provider (such as Stripe or PayPal). OmniComm does not store full card details.

9. Intellectual Property

9.1 Ownership of the Platform

All features, software, design elements, templates, artwork, logos, and game mechanics within LiberiComm are owned by LiberiComm or licensed to us. Users may not copy, distribute, reverse-engineer, or reproduce any part of the platform.

9.2 Licence to Use the Platform

Users receive a non-exclusive, non-transferable licence to use LiberiComm for educational and professional purposes. This licence does not permit resale, redistribution, sublicensing, or commercial exploitation of the platform.

9.3 Ownership of User-Created Resources

Users retain ownership of the resources and activities they create.

By creating or uploading content to LiberiComm, users grant LiberiComm permission to:

  • store it
  • display it to them and their pupils
  • publish it (only if chosen by the user)
  • use anonymised versions for internal testing, moderation, and analytics

LiberiComm does not claim ownership of user-created content.

9.4 Images Generated Through OpenAI API

LiberiComm uses the OpenAI API as its only image-generation and stock-image provider.

All images retrieved or generated through OpenAI remain subject to OpenAI’s licensing terms.

Users may:

  • use OpenAI images within LiberiComm resources
  • assign them to pupils
  • publish them inside LiberiComm

Users may not:

  • download OpenAI images for use outside LiberiComm unless permitted by OpenAI’s licence
  • redistribute or resell OpenAI content
  • upload OpenAI content to external platforms
  • remove or alter required attribution where applicable

OpenAI retains all rights to its content.

9.5 Third-Party Uploads and Attribution Requirements

Users must only upload content they have the legal right to use.

If uploaded content requires attribution, the user must include the appropriate credit in the description section of the generated resource.

The user is responsible for ensuring the credit is accurate and complies with the original licence.

LiberiComm is not responsible for copyright or attribution issues arising from user uploads.

9.6 Content Removal

LiberiComm may remove or restrict access to content that:

  • breaches copyright or licensing terms
  • infringes the rights of others
  • violates these Terms and Conditions
  • is inappropriate or harmful

9.7 Reporting Infringements

Users may report suspected copyright or licensing concerns via the contact email provided. LiberiComm will investigate and take action as needed.

10. Service Availability and Maintenance

10.1 General Availability

LiberiComm aims to provide reliable, ongoing access to the platform. However, continuous, uninterrupted service cannot be guaranteed. Access may be temporarily restricted due to maintenance, updates, or unforeseen technical issues.

10.2 Planned Maintenance

We may carry out scheduled maintenance to improve performance, security, and stability.

Where possible, users will be notified in advance through email or notices on the website.

10.3 Unplanned Interruptions

Unplanned downtime may occur due to technical faults, hosting issues, external outages, or emergency fixes.

LiberiComm will work to restore access as quickly as reasonably possible.

10.4 Data Safety During Maintenance

Maintenance—whether planned or unplanned—does not intentionally remove or change user-created resources, pupil accounts, or stored files.

LiberiComm uses secure storage and database practices designed to protect user data.

10.5 No Liability for Service Interruptions

LiberiComm is not responsible for losses, missed sessions, or disruptions caused by:

  • maintenance or updates
  • server outages or hosting provider issues
  • internet problems on the user’s side
  • third-party service failures (e.g., OpenAI API)

Use of the platform depends on the user’s own internet connection and device.

10.6 Updates and Feature Improvements

LiberiComm may introduce updates, improvements, new features, or interface changes at any time. Some updates may require temporarily suspending access.

10.7 Data Loss Disclaimer

LiberiComm takes reasonable steps to protect user data, but we cannot guarantee that data will never be lost, corrupted, or inaccessible.

Data loss may occur due to hardware failures, software errors, hosting provider problems, or events outside our control.

LiberiComm is not liable for any loss of data or consequences resulting from such loss.

11. Limitation of Liability

11.1 General Limitation

To the extent permitted by law, LiberiComm is not liable for any loss, damage, or inconvenience arising from:

  • use of the platform,
  • downtime or service interruptions,
  • loss or corruption of data,
  • errors or bugs,
  • third-party faults (including hosting providers or OpenAI API),
  • user mistakes or misuse of the service.

11.2 No Guarantee of Results

LiberiComm does not guarantee that:

  • the platform will meet every user’s specific needs,
  • all resources will always function without error,
  • pupil outcomes or progress will improve.

Users are responsible for ensuring the platform is appropriate for their individual educational context.

11.3 Indirect or Consequential Losses

LiberiComm is not responsible for indirect losses such as:

  • lost income,
  • lost profits,
  • loss of reputation,
  • replacement costs,
  • missed teaching sessions,
  • claims brought by others (e.g., parents, employers).

11.4 Maximum Liability

Where liability cannot be excluded under UK law, LiberiComm’s total liability is limited to the total amount paid by the user in the previous 12 months.

If the user is on a free plan, LiberiComm’s liability is limited to £0.

11.5 User Responsibility

Users are responsible for:

  • checking the accuracy of their own resources,
  • supervising pupil accounts,
  • complying with copyright when uploading content,
  • keeping login details secure.
